On February 14, 2024, U.S. Border Patrol agents initiated the first known seizure of state-legal cannabis at an interior border checkpoint in New Mexico, confiscating approximately 22 pounds valued at $139,000 from a licensed operator transporting products to Albuquerque from Las Cruces. This incident marked just the beginning of a series of enforcement actions against state-legal cannabis.
By October 2024, at least 17 stops had been reported, leading to a federal lawsuit filed by eight New Mexico cannabis companies against Customs and Border Protection (CBP).
As of June 2025, the lawsuit advanced to a new phase seeking to enjoin further seizures as total seized value has surpassed $1.7 million.
